Terms of use and sale

1. Purpose and acceptance

These terms of use and sale (“Terms”) govern access to the Kelio.AI website and the purchase of its services, offered by Hugo MARIE (sole trader, SIREN 131 728 669, 6 allée des Bleuets, 35133 Saint-Germain-en-Coglès, France, hugomariepro@gmail.com), hereinafter “Kelio.AI” or “we”.

Kelio.AI lets you generate videos from text or an image using artificial intelligence, edit them, share them in a public gallery (“Explore”) and, for subscribers, publish them on TikTok, Instagram and YouTube.

Creating an account and each purchase require acceptance of the Terms in force at that time. They can be viewed at any time at the bottom of every page and saved or printed.

2. Account and age requirement

The service is restricted to persons aged at least 18 with legal capacity to contract. By creating an account, you confirm that you meet this requirement.

You are responsible for keeping your login details confidential and for activity on your account. One account per person: creating multiple accounts to obtain benefits (including referrals) is prohibited.

You can delete your account at any time from the My data page.

3. Services and prices

Prices are in euros, all taxes included. VAT not applicable, art. 293 B of the French Tax Code. They are displayed before any order.

Credit packs (one-off payment):

• Starter — 50 credits — 7,99 €
• Créateur — 150 credits — 19,99 €
• Studio — 400 credits — 49,99 €
• Agence — 1000 credits — 109,99 €

Credit usage:

• Standard video (720p): 2 credits per second; Pro (1080p): 4 credits per second; length 3 to 15 seconds.
• Sound on: video cost × 2.
• “Product ad” template: + 3 credits per video.
• “Improve my prompt”: 1 credit; editor export: 2 credits. Both options are included at no credit cost for Kelio Creator subscribers.

The exact credit cost is always shown before starting a generation. If a generation or export fails, the debited credits are automatically returned.

Credits do not expire as long as the account exists. They cannot be converted into money, transferred or refunded, except as provided in the “Right of withdrawal” section and by law.

Kelio Creator subscription: 29,99 € per month, no commitment, renewed automatically every month on the same date until cancelled. It includes publishing and scheduling videos on TikTok, Instagram and YouTube, the “Improve my prompt” assistant and editor exports. It does not include generation credits.

If the subscription price changes, you will be informed by email at least 30 days in advance and may cancel free of charge before that date.

4. Ordering and payment

Before payment, you tick a box to accept these Terms and request immediate performance of the service (see next section). Payment is made by card via Stripe Payments Europe Ltd.; Kelio.AI never has access to your card details.

Credits are added to your account as soon as payment is confirmed. An invoice and order confirmation are sent to you by email. For the subscription, the amount is charged at sign-up and then every month.

If a monthly payment fails, Stripe retries it; without payment, the subscription is suspended and then cancelled.

5. Right of withdrawal

If you are a consumer, you have 14 days from the purchase to withdraw, without giving any reason (articles L221-18 et seq. of the French Consumer Code).

Credits and the subscription can be used immediately. At payment, you expressly request that the service begins before the end of the withdrawal period and acknowledge that:

• if you withdraw, you pay for the part of the service already provided (article L221-25): credits already used for a pack, days elapsed for the subscription;
• you lose your right of withdrawal once the service has been fully provided, i.e. when all credits in the pack have been used (article L221-28, 1°).

6. Cancelling the subscription

You can cancel at any time, free of charge, in a few clicks, with the “Cancel my subscription” button on the Publishing page. Cancellation takes effect at the end of the current, already paid monthly period; you keep access until then. A confirmation is sent to you by email.

Posts scheduled after the subscription ends may not be sent: please check them.

7. Free sign-up credits

Kelio.AI may offer credits when an account is created, to try the service. They are granted once per person and per email address, only after the address is verified, and are not granted to disposable email addresses or when too many accounts are created from the same connection. These credits are free: they are neither refundable nor exchangeable for money. Waiting-list members also receive the announced bonus credits if they create their account with the same email address. The amount offered may change or the offer may end at any time, with no effect on credits already granted. In case of abuse (multiple accounts), they may be withdrawn.

8. Referrals

A new user invited by a referral link or code gets 10% off their first credit purchase. Their referrer receives 10% of the credits bought in that first purchase, as credits. Referral credits are not refundable. In case of fraud (multiple accounts, self-referral), the benefits may be cancelled.

9. Acceptable use

You must not request, create, publish or distribute with Kelio.AI:

• any sexual content involving or sexualising minors in any way;
• any pornographic or sexually explicit content;
• the image or voice of an identifiable real person without their consent, including deepfakes that are deceptive or harm their dignity, privacy or reputation;
• violent, hateful, harassing or terrorist content, or content glorifying crimes;
• disinformation presented as real, scams or deceptive content;
• content infringing the rights of others (trademarks, works, protected characters), or images you do not have the right to use;
• any content that is illegal in France or in your country.

Requests are checked automatically before generation (filters and automated moderation): a request found to breach these rules is refused without debiting credits. Refusals are logged to prevent abuse. In case of serious or repeated breaches, we may remove content and suspend the account (generation, publishing and purchases blocked). You are informed by email of the reasons and can challenge the decision; you keep access to your data. An ongoing subscription may be cancelled, with the unused period refunded.

It is also prohibited to bypass the service's technical limits, scrape its content or disrupt its operation.

10. Your content and generated videos

You remain responsible for the text and images you submit and guarantee that you hold the necessary rights and permissions, including the consent of any recognisable person in an image.

Kelio.AI claims no rights over the videos you generate: you may use them, including commercially, in compliance with the law and these Terms. An AI-generated video may not be protected by copyright and may resemble content generated for others; we do not guarantee that it is unique.

To provide the service, you authorise us to store, process and display your content and to pass it to our technical providers (generation, storage, publishing). If you publish a video in Explore, you authorise us to display it publicly, with its prompt, without your identity, until you remove it.

Transparency: when you share a generated video depicting realistic people, places or events, you must clearly state that it was generated by artificial intelligence (EU AI Act, art. 50). Posts sent by Kelio.AI to social networks are automatically labelled as AI-generated, and video files contain an invisible technical label (metadata) stating that they were AI-generated: do not remove it.

11. Explore and moderation

Explore is a public gallery where you can choose to share your videos. Published videos are not reviewed by a human beforehand; they must comply with the acceptable use rules above.

Anyone can report content (“Report” button or email to hugomariepro@gmail.com, stating the link, reasons, name, email and a good-faith statement). As a precaution, a reported video is removed from Explore immediately and then reviewed.

When one of your videos is removed or your account is restricted, we tell you why (facts, rule concerned, how to challenge it). You can challenge the decision by email to hugomariepro@gmail.com, or before the competent court.

12. Publishing to social networks

Automatic publishing uses the Upload-Post service (TONVI TECH S.L., Spain). By linking your TikTok, Instagram or YouTube accounts, you authorise Kelio.AI to publish the videos you choose, with the title, description and date you set, and only at your request. You remain responsible for your posts and for complying with each network's rules. We cannot guarantee that a network will accept a post or that its services will be uninterrupted. You can unlink your accounts at any time.

13. Legal guarantees and liability

You benefit from the legal guarantee of conformity for digital content and services (articles L224-25-12 to L224-25-26 of the French Consumer Code): in case of lack of conformity, you can obtain that it be brought into conformity or, failing that, a price reduction or termination of the contract. By nature, artificial intelligence produces variable results: a video that does not exactly match your aesthetic expectations is not in itself a lack of conformity. A technically failed generation (error, missing video) is credited back automatically.

We use reasonable means to keep the service available; it may be interrupted for maintenance or if a provider fails. Nothing in these Terms limits our liability for gross or intentional misconduct or personal injury, or your consumer rights.

We recommend downloading the videos you want to keep.

14. Personal data

How we process your data is described in the privacy policy and the cookie policy.

15. Changes to the Terms

We may change these Terms. Purchases remain governed by the version accepted at the time of the order. For the subscription and account use, any significant change is notified to you at least 30 days in advance; you may cancel or delete your account before it takes effect.

16. Complaints, mediation and governing law

For any complaint: hugomariepro@gmail.com. If your written complaint has not been resolved, you may refer the matter free of charge to the consumer mediator: [À COMPLÉTER : nom du médiateur], [À COMPLÉTER : adresse postale du médiateur], [À COMPLÉTER : site du médiateur].

These Terms are governed by French law. If you are a consumer residing in another EU country, you keep the protection of the mandatory rules of your country. In case of dispute, you may bring the matter before the court of your place of residence or any court competent under the law.
